Explanation using Example

Imagine a scenario where Mr. Sharma, a factory worker, is entitled to receive a bonus from his employer as per the terms of an employment settlement. However, despite repeated requests, the employer fails to pay the bonus. Mr. Sharma can use Section 33C of the Industrial Disputes Act, 1947, to recover the money due.

Mr. Sharma, or someone authorized by him, can apply to the appropriate Government for the recovery of the bonus. The Government, after confirming the amount due, would issue a certificate to the Collector (or Chief Judicial Magistrate in Assam, as per the state amendment) to recover the amount like an arrear of land revenue.

If there is a dispute over the exact amount due, Mr. Sharma can approach a Labour Court designated by the Government to resolve the issue. The Labour Court's decision on the amount due will then be sent to the Government, and the money can be recovered as described earlier.
