Explanation using Example
Imagine a scenario where Mr. Sharma, a private executor of his late aunt's will, has been mishandling the estate by using the funds for his personal expenses. The beneficiaries of the will, upon noticing this, can approach the High Court with evidence of the mismanagement. If the High Court finds sufficient grounds, it may use Section 301 of The Indian Succession Act, 1925 to suspend, remove, or discharge Mr. Sharma from his duties as executor. The Court may then appoint a new executor to ensure the estate is properly managed and the beneficiaries receive their rightful inheritance.
