Example 1:
A woman named Priya was walking home from work late at night in Mumbai. She was suddenly accosted by a group of five men who forcibly took her to a secluded area and raped her. Each of these men acted together with a common intention to commit the crime. Under Section 376D of the Indian Penal Code, all five men are deemed to have committed the offence of gang rape. They are each sentenced to rigorous imprisonment for a term of not less than twenty years, which may extend to life imprisonment. Additionally, the court imposes a fine on each of the convicts, which is directed to be paid to Priya to cover her medical expenses and aid in her rehabilitation.
Example 2:
In a village in Uttar Pradesh, a woman named Sunita was attacked by three men who were known to her. These men had planned the attack together and took turns raping her in an abandoned house. The police arrested all three men, and they were charged under Section 376D of the Indian Penal Code. During the trial, it was established that the men acted in furtherance of a common intention to commit the crime. Consequently, each of them was sentenced to rigorous imprisonment for a term of not less than twenty years, with the possibility of life imprisonment. The court also ordered each convict to pay a fine, which was directed to be used for Sunita's medical treatment and rehabilitation.
