Imagine a scenario where the Central Government in India is in the process of constituting the Indian Nursing Council as per the Indian Nursing Council Act, 1947. Here's how Section 3 of the Act would be applied:
The government starts by identifying and electing one nurse from each State Nursing Council. For example, a nurse from the Kerala State Nursing Council is chosen by her peers to represent her state on the national council.
Next, two members are elected by the heads of institutions that provide advanced nursing education, such as a university degree in nursing or a post-certificate course in nursing teaching and administration.
Additionally, health visitor training institutions elect one of their heads to join the council. The Medical Council of India and the Indian Medical Association each elect a member, ensuring medical professionals' input on nursing matters.
The Trained Nurses Association of India also elects a representative, and a process is initiated for the rotational election of midwives or auxiliary nurse-midwives from groups of states.
Furthermore, several high-ranking officials like the Director General of Health Services and other ex officio members are included to provide their expertise.
The Central Government nominates four individuals, including nurses and an educationalist, to ensure a diverse and experienced council. Lastly, three members are elected by the Parliament to represent legislative interests.
Once the council is formed, they elect a President from among themselves, although for the first five years, the President is nominated by the Central Government.
It is also important to note that if there is a vacancy or a defect in the constitution of the Council, it does not invalidate the actions and decisions taken by the Council.
