Example Application:

Imagine Rita wants to sell her car and is approached by Vikram, who is interested in buying it. They both agree on a price, and Vikram consents to the purchase. However, Rita has not informed Vikram that the car has a major engine problem, which she is aware of. This is a case of misrepresentation under section 18 of the Indian Contract Act, 1872.

If Vikram later discovers the engine issue, he could argue that his consent was not free, as it was influenced by Rita’s misrepresentation of the car's condition. Under the Act, Vikram may have the right to void the contract and get his money back because his consent was not free and the contract was therefore not valid.
