Explanation using Example
Imagine a Hindu woman named Priya who passes away without leaving a will. She is survived by her husband, her mother, and two sons, one of whom predeceased her but left behind two children. According to Section 16 of The Hindu Succession Act, 1956, the order of succession to Priya's property would be as follows:
Example for Rule 1: Priya's husband and mother are both entitled to inherit, but the husband, being in the first entry of the heirs specified in Section 15(1), will have priority over the mother.
Example for Rule 2: The share of Priya's predeceased son would be equally divided among his two children, effectively granting them the portion their father would have inherited if he were alive at the time of Priya's death.
Example for Rule 3: If Priya had brothers or sisters, the distribution of her property would follow the same rules as if the property belonged to her father, mother, or husband and they had passed away intestate immediately after her, determining the order of succession among these relatives.
