Explanation using Example
Imagine a situation where a Hindu couple has a 4-year-old son and a 2-year-old daughter. Unfortunately, the father passes away. According to Section 6 of The Hindu Minority and Guardianship Act, 1956, the mother now automatically becomes the natural guardian of both the minor son and the minor daughter. This means she will be responsible for their personal care and managing any property they may own. Even though the father is traditionally the first guardian, in this case, the children are below the age of five, and the law specifically provides that the mother would ordinarily have the custody of such minor children.
