Example Application of Section 3 of The Employees Compensation Act, 1923:
Imagine a factory worker named Rohan who operates heavy machinery. One day, while working, a piece of equipment malfunctions due to a fault in the safety guard which was not maintained properly by the employer. As a result, Rohan's hand gets severely injured leading to partial disablement that lasts for more than three days.
Under Section 3(1) of The Employees Compensation Act, 1923, Rohan's employer would be liable to pay compensation for the injury caused because it occurred due to an accident arising out of and in the course of employment. The injury resulted in disablement exceeding three days, making Rohan eligible for compensation.
However, if Rohan had been under the influence of alcohol or had willfully disobeyed safety rules, the employer might not have been liable under the exceptions provided in the Act.
