Section 28A of CA, 1957 : Section 28A: Term Of Copyright In Works Of Public Undertakings
The Copyright Act, 1957
- CHAPTER V: TERM OF COPYRIGHT
28A Term of copyright in works of public undertakings - In the case of a work, where a public undertaking is the first owner of the copyright therein, copyright shall subsist until sixty years from the beginning of the calendar year next following the year in which the work is first published.
Simplified Act
Copyright Duration for Works Owned by Public Companies - If a work's first owner is a government-owned company, the copyright for that work will last for 60 years. This period starts from January 1st of the year after the work was first made available to the public.
Explanation using Example
Let's imagine that a public undertaking, for example, a government-owned publishing house, publishes a book in 2020. According to Section 28A of The Copyright Act, 1957, the copyright for this book will be owned by the public undertaking until the year 2080. This is calculated by adding 60 years to the year following the year of first publication (2020 + 1 + 60). Thus, until 2080, the public undertaking has exclusive rights to reproduce, distribute, and adapt the work.
