Explanation using Example
Imagine a situation where a new member was appointed to the Competition Commission of India (CCI), but there was a minor administrative error in the appointment process. Despite this, the Commission went on to decide a case involving two companies accused of entering into anti-competitive agreements. One of the companies, unhappy with the decision, tries to challenge the validity of the CCI's ruling by pointing out the error in the new member's appointment. According to Section 15 of The Competition Act, 2002, the decision of the CCI would not be invalidated simply because of this defect in appointment, as long as the error did not affect the merits of the case.
