Explanation using Example

Example 1:

Ravi, a resident of Mumbai, was a victim of a financial fraud in 2015. He discovered the fraud in 2018 and immediately filed a complaint with the police. However, due to various administrative delays, the police took a long time to investigate and finally submitted the charge sheet in 2021. By this time, the period of limitation for taking cognizance of the offence had expired. Ravi's lawyer argued that the delay was due to reasons beyond Ravi's control and that it was in the interest of justice to allow the court to take cognizance of the offence. The court, satisfied with the explanation and considering the gravity of the fraud, decided to extend the period of limitation and took cognizance of the offence.

Example 2:

Meena, a school teacher in Delhi, was subjected to harassment by a colleague in 2016. She was initially hesitant to report the matter due to fear of retaliation and social stigma. In 2020, after attending a workshop on women's rights, she gained the courage to file a complaint. By this time, the period of limitation for taking cognizance of the harassment offence had expired. Meena's lawyer presented the case to the court, explaining the reasons for the delay and emphasizing the importance of addressing harassment cases to ensure justice for victims. The court, recognizing the significance of the issue and the valid reasons for the delay, decided to extend the period of limitation and took cognizance of the offence.
