Example 1:
Scenario: Rajesh is walking home from work when a police officer approaches him and arrests him without a warrant.
Application of Section 50:
- Informing Grounds of Arrest: The police officer must immediately inform Rajesh of the specific reason for his arrest. For instance, the officer might say, "Rajesh, you are being arrested for suspected involvement in a theft that occurred at XYZ store."
- Right to Bail: If the offence Rajesh is accused of is bailable, the officer must also inform him that he has the right to be released on bail. The officer might add, "Rajesh, this is a bailable offence, and you have the right to arrange for bail. You can contact someone to act as your surety."
Example 2:
Scenario: Priya is at a protest when she is arrested by a police officer without a warrant for allegedly causing public disturbance.
Application of Section 50:
- Informing Grounds of Arrest: The police officer must immediately tell Priya why she is being arrested. The officer might say, "Priya, you are being arrested for causing a public disturbance during the protest."
