Explanation using Example

Imagine a couple, Ravi and Priya, who are Indian citizens. They moved to Canada in 1990, and their son, Arjun, was born there on December 15, 1995. To ensure Arjun's Indian citizenship by descent under Section 4 of the Citizenship Act, 1955, they need to take the following steps:

  1. Register Arjun's birth at the Indian consulate in Canada within one year of his birth.
  2. Since Ravi and Priya are Indian citizens (not by descent), they meet the requirement of clause (b) of the Act.
  3. Ensure that they do not hold a Canadian passport for Arjun, as per the amendment in 2003.

If they fail to register Arjun's birth within one year, they could still apply for registration with the permission of the Central Government after the expiry of the said period.

When Arjun turns 18, he must renounce his Canadian citizenship within six months to retain his Indian citizenship, as per subsection (1A).
